MW Stats – Nutzungsbedingungen

1. Anbieter und Geltung

Anbieter von MW Stats (Browser-Erweiterung, Web-Dashboard und Website mwstats.fomio.de) ist die Fomio Janssen & Poschen GbR, Münstergarten 84, 53332 Bornheim (siehe Impressum). Diese Bedingungen gelten für die Nutzung des Web-Dashboards, des optionalen Kontos und von Premium. Die Erweiterung selbst funktioniert auch ohne Konto vollständig lokal.

2. Leistungen

• Kostenlos: die Erweiterung, das Konto mit Google-Anmeldung und das Web-Dashboard mit seinen bisherigen Funktionen.
• Premium: zusätzliche Funktionen im Web-Dashboard (zum Beispiel längere Verläufe, Prognose, Highlights der Woche und des Monats, CSV-Export, Trend-Phasen und Keyword-Cluster). Welche Funktionen dazugehören, steht in der Premium-Ansicht deines Kontos und kann sich ändern. Bereits kostenlose Funktionen werden nicht kostenpflichtig, ohne dass wir das vorher ankündigen.

3. Konto und Verbindungen

• Das Konto ist für Personen ab 16 Jahren. Mit der Nutzung bestätigst du, dass du mindestens 16 Jahre alt bist.
• Das Konto ist freiwillig und an deine Google-Anmeldung gebunden. Halte deine Zugangsdaten bei Google geheim; du bist für Handlungen in deinem Konto verantwortlich.
• Die Verbindung mit MakerWorld bestätigst du mit einem Code in deiner öffentlichen Profil-Biografie. Verbinde nur dein eigenes Profil.
• Ein Patreon-Konto lässt sich nur mit einem MW-Stats-Konto verbinden. Premium ist persönlich und darf nicht weitergegeben oder weiterverkauft werden.
• Du kannst dein Konto jederzeit selbst löschen (so geht's).

4. Premium über Patreon

• Anbieter der Premium-Leistung ist die Fomio Janssen & Poschen GbR; die Mitgliedschaft schließt du über Patreon ab. Zahlungsabwicklung, Preise und Kündigung laufen über Patreon.
• Premium erhältst du mit einer bezahlten Mitgliedschaft auf unserer Patreon-Seite, ab der ersten bezahlten Stufe und in jeder bezahlten Stufe gleich. Preise, Zahlung, Abrechnung und Kündigung laufen ausschließlich über Patreon und deren Bedingungen; wir ziehen kein Geld ein.
• Du verbindest dein Patreon-Konto im Web-Dashboard (nur Anmeldung bei Patreon, wir erhalten keine Zugangsdaten). Ob Premium besteht, entscheidet allein unser Server anhand deines Mitgliedsstatus bei Patreon.
• Ende der Mitgliedschaft: Nach einer Kündigung oder einer fehlgeschlagenen Zahlung bleibt Premium noch 30 Tage aktiv (Karenzzeit), danach endet es automatisch. Erstattungen und Widerrufsrechte für deine Zahlung richten sich nach dem Gesetz und den Bedingungen von Patreon. Gesetzliche Verbraucherrechte, insbesondere zu Widerruf und Gewährleistung bei digitalen Leistungen, bleiben unberührt.
• Premium ist ein Zusatzangebot im Web-Dashboard. Es besteht kein Anspruch auf bestimmte Funktionen, ständige Verfügbarkeit oder auf Daten, die MakerWorld nicht (mehr) bereitstellt.
• Experimentelle Funktionen: Funktionen, die als „Experimentell“ gekennzeichnet sind (zum Beispiel Trend-Phasen und Keyword-Cluster), sind Näherungen ohne Gewähr. Sie können sich ändern, ungenau sein oder entfallen.
• Premium-Community (freiwillig): Schaltest du „Meine Werte mit anderen Premium-Mitgliedern teilen“ ein, fließen deine täglichen Kennzahlen als Summe in eine gemeinsame Auswertung aller teilenden Premium-Konten ein, die auch andere teilende Mitglieder sehen (aggregiert, erst ab 5 Konten, nie einzelne Konten). Du erlaubst Fomio dafür, diese Werte in die Auswertung einzubeziehen. Du kannst das jederzeit ausschalten; die Auswertung zeigt dich ab dann nicht mehr.

5. Inhalte und Creator-Freigabe

Modelle, Bilder und Titel gehören ihren Urhebern. Wir zeigen Bilder und Titel auf der Website nur von Creatorn, die in der Erweiterung ausdrücklich zugestimmt haben; die Freigabe lässt sich jederzeit widerrufen und läuft ohne Bestätigung nach 30 Tagen ab. Kennzahlen sind Auswertungen von Daten, die MakerWorld dir oder öffentlich anzeigt.

6. Erlaubte Nutzung

• Keine Umgehung von Premium-Sperren, keine automatisierten Massenabfragen und keine Handlungen, die den Betrieb stören oder die Sicherheit gefährden.
• Beachte beim Nutzen von MakerWorld dessen Nutzungsbedingungen. Die Erweiterung liest nur Daten, die deine Browser-Sitzung ohnehin lädt; für deine Nutzung von MakerWorld bist du selbst verantwortlich.
• Bei Verstößen dürfen wir den Zugang zum Konto oder zu Premium sperren.

7. Unabhängigkeit

MW Stats ist ein unabhängiges Projekt von Fomio und steht in keiner Verbindung zu Bambu Lab, MakerWorld oder Patreon und wird von diesen weder unterstützt noch geprüft. Alle Marken gehören ihren jeweiligen Inhabern.

8. Verfügbarkeit, Genauigkeit und Haftung

• Wir bemühen uns um einen zuverlässigen Betrieb, können aber Unterbrechungen, Wartung und Änderungen bei MakerWorld nicht ausschließen. Zahlen, Verläufe, die Prognose sowie Trend-, Cluster- und Saison-Auswertungen sind Auswertungen ohne Gewähr und keine Zusage über künftige Ergebnisse.
• Wir haften unbeschränkt bei Vorsatz und grober Fahrlässigkeit, bei Verletzung von Leben, Körper oder Gesundheit und nach dem Produkthaftungsgesetz. Bei leicht fahrlässiger Verletzung wesentlicher Vertragspflichten (deren Erfüllung den Vertrag erst ermöglicht) ist die Haftung auf den vorhersehbaren, typischen Schaden begrenzt. Im Übrigen ist die Haftung ausgeschlossen. Gesetzliche Rechte für Verbraucher bleiben unberührt.

9. Änderungen und Beendigung

Wir können Funktionen und diese Bedingungen ändern, wenn ein triftiger Grund vorliegt (technische, rechtliche oder Plattform-Änderungen oder Weiterentwicklung), die Änderung für dich zumutbar ist und kein zusätzliches Entgelt verursacht. Wir informieren vorab im Web-Dashboard oder im Changelog der Erweiterung, bei wesentlichen Nachteilen mindestens 14 Tage vorher. Beeinträchtigt dich eine Änderung mehr als nur geringfügig, kannst du die Mitgliedschaft bei Patreon und dein Konto jederzeit ohne Frist beenden. Du kannst die Nutzung jederzeit beenden und dein Konto löschen.

10. Recht und Kontakt

Es gilt deutsches Recht; zwingende Verbraucherschutzvorschriften deines Wohnsitzstaates bleiben unberührt. Wir sind zu einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle weder verpflichtet noch bereit. Fragen: info@fomio.de oder Kontaktformular.

1. Provider and scope

MW Stats (browser extension, web dashboard and the website mwstats.fomio.de) is provided by Fomio Janssen & Poschen GbR, Münstergarten 84, 53332 Bornheim, Germany (see Impressum). These terms apply to the web dashboard, the optional account and Premium. The extension itself works fully locally without an account.

2. Services

• Free: the extension, the account with Google sign-in and the web dashboard with its existing features.
• Premium: additional web dashboard features (for example longer trends, forecast, highlights of the week and month, CSV export, trend phases and keyword clusters). The Premium view of your account lists what is included; this may change. Existing free features do not become paid without prior notice.

3. Account and connections

• The account is for people aged 16 and over. By using it you confirm that you are at least 16 years old.
• The account is optional and tied to your Google sign-in. Keep your Google credentials secret; you are responsible for actions in your account.
• You confirm the MakerWorld connection with a code in your public profile biography. Connect only your own profile.
• A Patreon account can be linked to only one MW Stats account. Premium is personal and must not be passed on or resold.
• You can delete your account yourself at any time (how).

4. Premium via Patreon

• The provider of the Premium service is Fomio Janssen & Poschen GbR; you take out the membership via Patreon. Payment processing, prices and cancellation are handled by Patreon.
• You get Premium with a paid membership on our Patreon page, from the first paid tier and identical in every paid tier. Prices, payment, billing and cancellation are handled exclusively by Patreon under its terms; we do not collect money.
• You link your Patreon account in the web dashboard (sign-in at Patreon only, we never receive your credentials). Whether Premium applies is decided solely by our server based on your membership status at Patreon.
• End of membership: after a cancellation or a failed payment, Premium stays active for another 30 days (grace period) and then ends automatically. Refunds and withdrawal rights for your payment follow the law and Patreon's terms. Statutory consumer rights, in particular on withdrawal and warranty for digital services, remain unaffected.
• Premium is an add-on in the web dashboard. There is no entitlement to particular features, constant availability or data that MakerWorld does not (or no longer) provide.
• Experimental features: features marked “Experimental” (for example trend phases and keyword clusters) are approximations without warranty. They may change, be imprecise or be removed.
• Premium community (voluntary): If you switch on “Share my values with other Premium members”, your daily figures are added as a total to a joint analysis of all sharing Premium accounts that other sharing members also see (aggregated, from 5 accounts onwards, never individual accounts). You allow Fomio to include these values in that analysis. You can switch it off at any time; from then on the analysis no longer includes you.

5. Content and creator consent

Models, images and titles belong to their authors. On the website we show images and titles only of creators who explicitly agreed in the extension; consent can be withdrawn at any time and expires after 30 days without confirmation. Figures are evaluations of data that MakerWorld shows you or the public.

6. Permitted use

• No circumvention of Premium restrictions, no automated mass requests and nothing that disrupts operation or endangers security.
• Follow MakerWorld's terms when using MakerWorld. The extension only reads data your browser session loads anyway; you are responsible for your own use of MakerWorld.
• In case of violations we may suspend access to the account or Premium.

7. Independence

MW Stats is an independent Fomio project, not affiliated with Bambu Lab, MakerWorld or Patreon, and neither supported nor reviewed by them. All trademarks belong to their respective owners.

8. Availability, accuracy and liability

• We aim for reliable operation but cannot rule out interruptions, maintenance or changes at MakerWorld. Figures, trends, the forecast as well as trend, cluster and seasonal analyses are evaluations without warranty and no promise of future results.
• We are fully liable for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For slightly negligent breach of essential contractual obligations (those that make the contract possible in the first place), liability is limited to foreseeable, typical damage. Otherwise liability is excluded. Statutory consumer rights remain unaffected.

9. Changes and termination

We may change features and these terms where there is a valid reason (technical, legal or platform changes, or further development), the change is reasonable for you and causes no additional charge. We will inform you in advance in the web dashboard or the extension changelog, for changes with material disadvantages at least 14 days before. If a change affects you more than slightly, you may end your membership at Patreon and your account at any time without notice. You may stop using the service and delete your account at any time.

10. Law and contact

German law applies; mandatory consumer protection provisions of your country of residence remain unaffected. We are neither obliged nor willing to take part in dispute resolution before a consumer arbitration board. Questions: info@fomio.de or the contact form.
